These SMS Terms & Conditions (“SMS Terms”) govern your participation in the What’s Good Charlotte SMS Program provided by What’s Good Charlotte, a service of The Good Collective, LLC (“What’s Good Charlotte,” “we,” “us,” or “our”).
By voluntarily opting in to receive text messages from What’s Good Charlotte, you agree to these SMS Terms and acknowledge that your participation in the What’s Good Charlotte SMS Program is also subject to our Privacy Policy and applicable laws and regulations.
What’s Good Charlotte operates an SMS Program that allows subscribers to receive text messages about Charlotte-area events, things to do, local experiences, business and restaurant spotlights, recommendations, promotions, What’s Good Charlotte content, and related updates.
Subscribers may join the SMS Program through an approved What’s Good Charlotte sign-up form, QR-code opt-in, SMS keyword, or other affirmative enrollment method.

For purposes of these Terms, “Mobile Messaging” means communications delivered to a mobile telephone number through supported messaging technologies, which may include SMS, MMS, RCS, or other mobile messaging technologies.
The specific messaging technology available to you may depend on your mobile carrier, device, messaging application, geographic location, and other technical factors.

By providing your mobile telephone number and affirmatively opting in to receive text messages, you expressly consent to receive recurring automated text messages from or on behalf of What’s Good Charlotte at the mobile number you provided.

Your consent is voluntary and is not a condition of purchasing any product, service, ticket, membership, or other offering from What’s Good Charlotte.
SMS consent is separate from acceptance of our Terms of Service and Privacy Policy.
By opting in, you represent that you are the account holder or authorized user of the mobile telephone number provided and that you have permission to enroll that number in the SMS Program.
You must be at least 18 years of age (or the age of majority in your jurisdiction) to enroll in the What’s Good Charlotte SMS Program.

Certain events, venues, businesses, promotions, or experiences featured by What’s Good Charlotte may have additional age restrictions, including requirements that attendees be 21 years of age or older.
Participation in the SMS Program does not grant access to any age-restricted event, venue, product, service, or promotion.
Your consent applies specifically to the What’s Good Charlotte SMS Program for which you provided consent.
Your consent does not authorize unrelated businesses, organizations, advertisers, affiliates, or other third parties to send their own marketing messages to you.
What’s Good Charlotte does not sell, rent, transfer, or provide its SMS subscriber list to other businesses for their independent marketing purposes.

The number of messages you receive may depend on your interactions with What’s Good Charlotte and the events, promotions, content, or services for which you have provided consent.
We do not guarantee a specific number of messages per week or month.

What’s Good Charlotte does not charge you a fee to receive SMS messages. However, your wireless carrier may charge you for text messages or data usage according to your wireless plan.
You are responsible for any applicable charges imposed by your mobile carrier or service provider.
You may stop receiving promotional text messages at any time by replying:

to any message from the What’s Good Charlotte SMS Program.
After you send an opt-out request, you may receive a confirmation message acknowledging your request. You will no longer receive promotional messages unless you subsequently provide consent to receive them again.
Opting out of promotional messages does not necessarily prevent you from receiving certain non-promotional or transactional communications that you have separately authorized or that are necessary to provide a service or complete a transaction you have requested.

Your mobile number and SMS consent information may be disclosed to service providers that assist us in operating our business and SMS Program, including messaging platforms, technology providers, hosting providers, security providers, customer-support providers, analytics providers, and other operational service providers.
These service providers may process your information only as necessary to provide services to What’s Good Charlotte and are not authorized to use your mobile number or SMS consent information for their own independent marketing or promotional purposes.
The What’s Good Charlotte SMS Program primarily uses SMS and MMS messaging.
Where supported by the applicable carrier, device, messaging application, and technology, certain communications may be delivered through other mobile messaging technologies, including RCS.
Carriers are not liable for any delayed or undelivered messages.
What’s Good Charlotte is not responsible for messages that are delayed, undelivered, misdirected, or otherwise affected by your wireless carrier, network conditions, device limitations, or circumstances outside our reasonable control.
If you change, transfer, or deactivate the mobile telephone number associated with your SMS subscription, you agree to update your information or opt out of the SMS Program.
You are responsible for ensuring that the mobile number you provide remains accurate and under your control.
What’s Good Charlotte intends to operate its SMS Program in accordance with applicable federal and state laws, regulations, carrier requirements, and industry standards governing electronic and mobile communications.
We may suspend, modify, or terminate the SMS Program when necessary to comply with applicable law, carrier requirements, platform requirements, or our policies.

Updated terms will become effective when posted to our website unless otherwise required by applicable law.
Your continued participation in the SMS Program after updated terms become effective constitutes your acceptance of the updated SMS Terms.
These SMS Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-law principles.
Any dispute arising out of or relating to these SMS Terms or the SMS Program will be subject to the applicable courts located in North Carolina, unless otherwise required by applicable law or provided in a separate agreement between you and The Good Collective, LLC.
Nothing in this section limits any rights or remedies that cannot lawfully be waived under applicable federal or state consumer-protection laws.
